Spotaband Terms and Conditions - Artists and Users

User Terms and Conditions

User must agree to abide by the following Terms & Conditions and the terms as stated in the Privacy Policy.

User is over 13 years of age.

You "The User" consent to receiving email notifications from Spotaband "The Service" concerning your account and activity thereof. Should you consent to other forms of communication, such as, but limited to: SMS, text, data alerts; you agree that any charges that occur as a result from your internet or mobile carrier are the sole responsibility of the User.

All content included in and made available by Spotaband is protected by United States and international copyright law. Exceptions are: Spotaband does not make any warranties or guarantees that Artist or User content does not violate United States and international copyright law. It is the User’s responsibility to ensure content provided by User is lawful under current laws and regulations. Content includes, but is not limited to: music, lyrics, images, audio, video, and written content.

We respect the intellectual property of others, please contact us if you believe works have been used in violation of United States and international copyright law.

User agrees to use the Spotaband services as intended and not for purposes that may be unethical or illegal. This includes using Spotaband to post anything hateful, racist, or harassing in nature.

Artist Terms and Conditions

Artist must agree to abide by the following Terms & Conditions and the terms as stated in the Privacy Policy.

Artist is over 13 years of age.

You, "The Artist", consent to all Terms and Conditions required for a User.

All content included in and made available by Spotaband is protected by United States and international copyright law. Exceptions are: Artist content owned by Artist and protected by United States and international copyright law. Spotaband does not make any warranties or guarantees that Artist content and/or User content does not violate United States and international copyright law, it is the Artist responsibility to ensure content provided by Artist is lawful under current laws and regulations. Content includes, but is not limited to: music, lyrics, images, audio, video, and written content.
Artist provides that any non-original works including, but not limited to: music, lyrics, images, audio, video, and written content, is properly licensed and Artist has the rights and authorization to allow publication on Spotaband.

Artist agrees to cease direct communication with User once notified by Spotaband that User no longer wishes to be contacted by the Artist, or User has opted to make contact information private. Failure to do so may lead to a suspension of Spotaband services.

Artist agrees to use the Spotaband services as intended and not for purposes that may be unethical or illegal. This includes using Spotaband to post anything hateful, racist, or harassing in nature.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

SPOTABAND SERVICES AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) AND OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH SPOTABAND ARE PROVIDED BY SPOTABAND ON AN "AS IS" AND "AS AVAILABLE" BASIS. SPOTABAND MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF SPOTABAND SERVICES, OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH SPOTABAND SERVICES, UNLESS OTHERWISE SPECIFIED IN WRITING. YOU EXPRESSLY AGREE THAT YOUR USE OF SPOTABAND SERVICES IS AT YOUR SOLE RISK. TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, SPOTABAND DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. SPOTABAND DOES NOT WARRANT THAT SPOTABAND SERVICES, INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH SPOTABAND SERVICES, SPOTABAND SERVERS OR ELECTRONIC COMMUNICATIONS SENT FROM SPOTABAND ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. SPOTABAND WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF ANY SPOTABAND SERVICE, OR FROM ANY INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH ANY SPOTABAND SERVICE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES, UNLESS OTHERWISE SPECIFIED IN WRITING. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES.
